“Is Elena listening?”
Alma looked over to her and put her on speaker.
“Elena, I want to make sure you hear this,” said Rosalie, pursing her lips vigorously and making
cat like squints, “Are you close - to the phone?”
“Yes, Mrs. Fusseltoes, I -- I am,” gulped Elena. Fearing what she was about to hear.
“Your mother is out of status. She filed an EB-3 before the labor certification was approved and
that is grounds for denial.”
“De – ni –al?” Elena said slowly.
Alma’s heart sank as she faced Elena.
“I am ordering your mother be returned to Mexico. After five long years we have determined that
we are wasting valuable resources on her case, when other, more educated, more deserving, extremely
talented entrepreneurs and scientists could use her spot.”
“Re –turned?” as if her mother was a re-ject, she answered slowly,” Is there something I can do?
Something I can file?’
“Your ONLY recourse is to file an appeal with grounds – within the next 30 days. But I don’t
think you can do that, can you?” said Rosalie accusingly, mad to close this file and shove it off her desk.
Elena thought carefully, but before she could answer -- the phone went click.
“30 days? Is that enough time? What can we do? Why does she call us Birds?”
“It’s burd. B – U - R –D. As in burd-en.” Elena trying hard to make the connection, looking at
Alma quizzically, “She says we are a burden on America. Sometimes she calls us BOA’s. Let me call
your mother,” said Alma, feeling a snowstorm of chaos coming.
Elena, already on her computer, searching…. reads the instructions, “For cases of denial,
the judge will hear such cases in Los Angeles.”
